EWC fraud: Hellio contests the DGEC's sanction decision and takes action before the Council of State

In an interview published in The Parisian On November 25, the Minister Delegate for Energy, Olga Givernet, accused 5 companies of fraud with energy savings certificates (EEC). She also denounced the persistent embezzlement generated by aid for energy renovation.

According to her, TotalEnergies, Dalkia (a subsidiary of EDF), the supplier Sefe Energy, as well as two companies with a delegation to implement CEEs, Hellio Solutions and Teksial, would have misused the aid system for individuals, professionals and communities, which is based on the polluter pays principle. She criticizes them for having “ requested certificates for renovation work, even though they had not been carried out, or the results were not up to the reduction objectives announced.”

The EEC system, always at the heart of controversies! It had already been singled out last September in a report by the Court of Auditors which called for a major reform.

The companies concerned were subject to EWC cancellations amounting to 6 million euros and fines. The sanctions were published on November 26 at Official Journal.

Companies reacted and denied the fraud

The companies in question denied the fraud in a press release. TotalEnergies and Hellio have announced their intention to appeal to the Council of State to cancel them.

The Hellio Group, which will have to pay a fine of approximately 2.4 million euros, declares having taken note of the interview as well as the sanction decision pronounced by the General Directorate of Energy and Climate (DGEC). He intends to provide clarifications regarding the comments made and the sanction decision.

« The Hellio group takes note of the sanction decision of the DGEC and immediately contacted the Council of State for cancellation of this sanction in order to be restored to its rights. he explains.

Opposed both in form and in substance to the arbitrary decision taken, the company specializing in energy management solutions brought an appeal before the Council of State to contest the sanction based, according to it, on a reading extensive of the energy code.

“The group, which contests any fraud, intends, through this action, to defend its positions, its probity and prove its good faith. In a period marked by discussions around the definition of the 6th period of the EWC, it is necessary that all stakeholders act responsibly. Hellio reserves the right to take any appropriate legal action in the event of defamatory comments. » , he concludes.
