In the case relating to the fictitious assistants of the FN in the European Parliament, the prosecution demanded the ineligibility of Marine Le Pen. A necessary measure of protection for society against unethical politicians, supports the former member of Parliament for Seine-Saint-Denis.

The possibility that the court would declare Marine Le Pen ineligible has provoked a barrage of critical reactions from politicians ranging from Gérald Darmanin to Karl Olive (himself recently convicted) and, more surprisingly, to Jean -Luc Mélenchon. For Darmanin, the penalty of ineligibility should not apply to her, because she plans to run in the presidential election in 2027. Jean-Luc Mélenchon, for his part, declared that he was opposed to 'on the one hand to the automaticity of the additional penalty of ineligibility, and on the other hand to the provisional execution of the penalty of ineligibility to Marine Le Pen, indicating that “the political crisis would be aggravated without any benefit to society”.

Let us first remember that eligibility is not an absolute right. There are rules regarding age, nationality, place of residence, professional incompatibilities, as well as non-cumulative rules, such as the one which deprives Emmanuel Macron of the right to run in the next presidential election.
