The factors influencing the sentence are mainly criminal records, recidivism et the state of the individual at the time of the check.
As for alcohol, the penalties are also similaralthough the maximum penalty can reach three years in prison. If alcohol and drugs are combined, the judge may be more severe, but the sanctions remain generally the same.
Finally, regarding the creation of the offense of road homicidethe bill still needs to be debated by deputies. Although the penalties incurred would remain the same as currently, the qualification of “road homicide” could encourage magistrates to impose harsher sentences for those who cause the death of a person on the road.
