Newly elected President Donald Trump sees upcoming deadlines canceled in legal proceedings against him over the 2020 election.

UNITED STATES – An electoral victory coupled with a (quasi) legal victory. While the American president-elect is being prosecuted for trying to reverse the results of the 2020 American presidential election, in which he lost to Joe Biden, the judge in this trial canceled all deadlines on the calendar on Friday, November 8 of the affair. Good news for Donald Trump, which very likely augurs an outright suspension of the proceedings against him.

This decision comes after a request from special prosecutor Jack Smith. Recalling that the elected president must be inaugurated on January 20, the latter motivated his request by the need to give the prosecution “the time to analyze this unprecedented situation and determine the course of action to follow in accordance with the policy of the Ministry of Justice”.

The special prosecutor and the Department of Justice began discussions on Wednesday, November 6, the day of the vote results, with a view to stopping the federal prosecution against Donald Trump initiated by Jack Smith, several American media reported.

The special prosecutor clarified that he will present “the result of its deliberations” by December 2. Asked by AFP, the ministry declined to comment.

An unsurprising decision

The department has had a policy of not prosecuting a sitting president for more than 50 years. The situation of a presidential candidate being criminally prosecuted and then elected is unprecedented, but most legal commentators expect an extension of this policy to the case of Donald Trump, which would allow him to escape federal prosecution until the end of his new mandate.

Back in the White House, he could either appoint a new Justice Minister who would fire Jack Smith or simply order his Justice Department to drop the charges against him.
