The United States Department of Commerce (DOC) has published the final results of the second administrative review regarding countervailing duties on imports of Moroccan phosphate fertilizers to the United States. The rate applicable to these imports thus increased, from 14.21% to 16.81%.
This new rate of 16.81% is applicable retroactively to exports to the United States from the year 2022 and also payable by American customs in the event of imports of phosphate fertilizers from today until 2026. The duration of application of this rate may exceed this date if a new administrative review is carried out, which would result in the establishment of a new rate.
«OCP notes that, despite the evidence and detailed arguments provided throughout the review process conducted by the United States Department of Commerce (DOC), the latter rendered a fundamentally erroneous decision, the increase in the rate resulting from the application by the DOC of inadequate methodologies, not in conformity with the applicable laws and regulations, and not supported by the elements of the file», deplores the OCP group in a note published on its website.

The OCP group says it is convinced that “there is no justification for imposing any duties on its fertilizer imports into the United Statess”. Therefore, the group has decided to appeal these decisions to the US Court of International Trade and is also considering the possibility of appealing this decision.
