A man, sentenced to ten years in prison for the rape of a minor, appealed his decision. Due to the lack of a date for his trial, he was released.
The congestion of hearings sometimes has serious consequences. A 30-year-old man, sentenced to ten years of criminal imprisonment in January 2024 for raping his minor niece, was released at the beginning of January, BFMTV learned from a judicial source, confirming information from RTL and the Parisian.
The thirty-year-old had appealed against his conviction pronounced on January 16, 2024 by the Yvelines Assize Court. As required by law, his appeal trial should have been held within a maximum of one year.
But due to the congestion of the hearings, no date could be fixed within the allotted time. In fact, the man was released in January 2025.
A trial in June 2025
The general prosecutor's office had anticipated this, by filing a request for an exceptional extension of the detention on December 11, 2024. But it was decided, against the advice of the general prosecutor's office, to release the thirty-year-old on Wednesday January 8. Furthermore, the man was released without being placed under judicial supervision, as the law does not provide for it in this specific case.
-A date has since been set. The accused will be tried in June 2025 before the Hauts-de-Seine Assize Court of Appeal. It remains to be seen whether he will show up for his trial. The thirty-year-old, of Malian origin, can leave the national territory at any time due to lack of judicial control.
