The plaintiff’s lawyers denounce “an investigation conducted with violence and without objectivity”

In a 20-page document that BFMTV was able to consult, the lawyers of the Argentinian woman who accuses Oscar Jegou and Hugo Auradou of having raped her requested that the two magistrates be challenged “for moral violence and lack of objectivity”.

This Tuesday, not only did the Argentine justice system agree that Oscar Jegou and Hugo Auradou could return to France before Thursday’s crucial hearing on the request for dismissal of the case, but it also refused the request made on Monday by the plaintiff’s lawyers to challenge the two prosecutors in charge of the investigation, considering it to be “unfounded”.

In a 20-page document that BFMTV was able to consult, the lawyers of the young Argentinian woman requested that the two magistrates be challenged “for moral violence and lack of objectivity”. “Our request is extremely urgent given the imminent danger, and we also wish that the two accused be kept at home in Argentina under current conditions”, could be read in substance in their request, since refused.

Doctor’s report contains “contradictions”

The lawyers for the civil party considered in this document that the two prosecutors had been conducting a “biased and biased investigation against the victim” from the beginning by truncating, according to them, conversations between the complainant and two of her friends after the events to cast doubt on her accusations, or by relying on the medical examination carried out on July 8 by a forensic doctor who was very young in the profession, according to them.

“This doctor herself says in her report that she has been a forensic examiner since last May, and her report contains contradictions and gaps in the analysis of the blows and injuries to our client’s body. And yet, the prosecutors did not consider it necessary to have this report checked and have these examinations redone by a more experienced doctor,” the defense is offended, citing extracts where the doctor seems to minimize, for example, the gynecological injuries observed.

New development this Thursday?

The lawyers also return at length to the psychological state of their client, currently hospitalized, and mention her suicide attempt when she tried to throw herself out of her car onto the road while her father was driving, around 3 a.m. last Friday.

Contacted by BFMTV, the plaintiff’s lawyers did not wish to comment for the moment, but did stress in one sentence their astonishment at the speed with which the courts rejected their request, less than 24 hours after it was filed. “A record,” one of them commented.

Now, the investigation is set to take another new turn on Thursday during a hearing, with the summoning of psychiatric experts who were able to meet the complainant, and the decision on the request for dismissal made by the defense of the two rugby players, who will probably already be back in France at that time.
