An unworthy father who transmitted herpes to his 6-year-old daughter during multiple sexual assaults has headed to the penitentiary for the next 11 years, even though he continues to say he was only “taking care” of the child.
“There is no recognition of his actions in any way […]. On the contrary, it remains in justification, rationalization and negation,” deplores judge Christian Jarry in his recent decision rendered at the Saint-Hyacinthe courthouse.
The 41-year-old accused, who cannot be named in order to protect the identity of his victim, committed his crimes in 2016, while his young daughter had to treat urinary infections.
“Protective cream must be applied regularly to his genitals,” explains the judge. The story could have ended there, but the reality is quite different.”
Traumatized
Because at these times, the unworthy father took the opportunity to sexually abuse the child. In two years, the victim was attacked around fifteen times, contracting genital herpes from her father.
“Now aged 14, she now feels fear at the idea of having physical contact with others,” explains the judge. Obviously, his herpes infection affects him a lot. She has to take medication and she foresees difficulties in her future romantic relationships.”
The accused was quickly arrested. And during the search of his home, the police discovered that he was using his ex-partner’s passwords to spy on her online, and that he was collecting child pornography.
A total of 1,543 files, including children as young as 4 years old, were found on his computer.
-Invented story
During his testimony, the unworthy father made up excuses, claiming to have spied on his ex-partner to ensure that her new lover did not attack the child. As for the child pornography, he claimed that it had been stolen from the new spouse “in order to ensure that his daughter was not there.”
His excuses, described by an expert as “equally far-fetched and implausible,” were rejected by the judge.
«[L’enfant] had the right to consider his residence as his castle, as a place where nothing could happen to him,” said the judge.
Thus, there was no question that this unworthy father would receive a sentence of seven or eight years in penitentiary, as the defense suggested. Because when it comes to crimes against children, the sentences must be exemplary, recalled the magistrate.
He therefore received 11 years of incarceration. During this period, he will be prohibited from communicating with the victim. And once he is free, he will be prohibited from being in contact with young people, with some exceptions, for 10 years. He will also be placed on the sex offenders register until his death.
