Rejected. In the booby-trapped device case, the Restraint Measures Court (TMC) in Bern has just decided to keep the older brother in detention, in Sion (Valais). The lawyer for this 32-year-old from Valais, Me Vincent Spira, made the request for provisional release on December 27. He had notably emphasized that his client was not in Geneva at the time of the three events (the booby-trapped device placed in a milk box in Plan-les-Ouates at the beginning of April 2024; the explosion of a garbage bag in Saint- Jean on August 20, and from a mailbox in Petite-Boissière on November 25).
The TMC order specifies: “Even admitting that he seems to have been in possession of the equipment and knowledge necessary to do this.
Enough to make Me Spira jump. “It is extremely shocking to be able to keep someone in detention on a simple hypothesis made by hundreds or even thousands of people in Switzerland,” says the lawyer, referring to the fact that the Internet can make it possible to obtain information. on the making of such devices.
As for the material seized from the home of the thirty-year-old, a professional computer scientist, it would not, according to the criminal lawyer, be explosives but simple strings, electric cables or even clothespins, likely to be found in any handyman’s home. . “I maintain that the file is empty,” says Me Vincent Spira. And added: “I will study with my client the possibility of appealing against this order.”
As a reminder, the younger brother, aged 26 and living in Geneva, was released just before Christmas. He was arrested at the same time as his older brother and placed, like him, in preventive detention for a period of two months. The investigation had in fact revealed that his phone had been limited near the three places concerned. However, it turned out that his professional schedule, as a driver, could explain his presence. Hence the TMC’s decision to release him. This was welcomed by his lawyer Robert Assaël, noting, however, the trauma of the arrest and the few days of detention for his client.
