Calls to adopt a scientific approach and bring academics into the debate

The new family code continues to attract the attention of public opinion and also that of experts. Several of them came together to emphasize the imperative of adopting a legal structure in the formulation of the articles that could appear in the new Family Code.

Academics, experts and professionals gathered around a round table devoted to the discussion of the provisions of the revision of the Family Code (Moudouwana) all called for adopting a scientific approach and a legal structure in the formulation of the articles for their understanding

According to the speakers, the Moroccan university could play a role in responding to the societal questions facing Morocco, particularly in terms of paradigm shifts and their application in the family code.

They considered that universities could initiate dialogues, reflection and the exchange of ideas to develop the debate on the proposed modifications and amendments of certain texts.

The speakers encouraged academics, whatever their specialty, to participate in the scientific debate on the revision of the Family Code, as well as problems linked to the social environment, and to deconstruct the societal discourse which remains legitimate but lacking references and methodology to supervise its interactions.

After emphasizing that it is not possible to adopt only an in-depth academic approach to family issues without taking into account practice on the ground, they highlighted that the Moroccan university can offer answers to ensure family stability through varied approaches and from different angles.

They specified that the Faculty of Letters and Human Sciences of Rabat attaches great importance to family studies, both scientifically and academically, because it brings together different specialties necessary in this regard, with departments such as psychology, sociology, Islamic sciences, and that it houses a center specializing in family studies which adopts a global approach and builds bridges between different disciplines.

According to them, academic discourse could block the path to errors of appreciation or interpretation of the new provisions. Likewise, it would make it possible to correct the latter in public debates by relying on a solid scientific orientation to address questions related to the revision of the Family Code.

As a reminder, the revision of the Family Code has generated a heated debate between “modernists” and “traditionalists”, or between those who seek to protect women’s rights and those who want to keep advantages granted to men that disadvantage mothers. , wives and sisters within a family.
