XALIMANEWS: Information widely relayed on the web, the director of the Senegalese Rural Electrification Agency (ASER) stepped up to deny the rejection of his request by the Supreme Court
According to Jean Michel SENE, who spoke in Le Soleil, “in addition to the action for annulment, we had introduced an interim order with a view to suspending the ARCOP decision. What happened yesterday was that the Supreme Court rejected the emergency application, but it intends to rule on the merits of the case.”
“The Supreme Court has not yet ruled on the merits. We are therefore waiting for the Supreme Court to decide on the merits. We are waiting to be summoned to examine the merits of the case. The appeal that we have filed aims to determine whether ARCOP is competent to suspend a contract in progress,” he indicated.
For him, there is case law in the ASER-AEE Power-AEE Power Senegal case because “these are two private individuals linked by a commercial contract. They must resolve their disputes in court in the absence of amicable solutions.
