The trial of Sen TV columnist Ameth Ndoye and his accomplice Abdoulaye Sow (police officer) opened this Monday morning. But the defense raised an exception based on the provisions of article 55 of the code of criminal procedure. The decision of the Dakar flagrante delicto court on this exception is expected on Thursday, November 7, 2024.
“Ameth Ndoye’s rights have been violated. After his detention, the gendarmes informed him of his right to be assisted by a lawyer. So this should be done as soon as he is arrested,” recalled Me Souleymane Soumaré.
For Me Amadou Sall, “the procedure is completely void. The accused was interviewed the next day without being informed.” Me Aboubacry Barro also requested “the cancellation of the procedure”.
On the other hand, the public prosecutor asked the judge to reject the exception. For the prosecution, the formalities were respected. According to the representative of the public prosecutor, “Ameth Ndoye was arrested following a wanted notice. He spoke with his counsel before facing investigators. Concerning the second interrogation, the representative of the public prosecutor believes that the investigators are not required to notify his lawyers.
As a reminder, Ameth Ndoye was placed under arrest warrant for lack of driving license, unintentional injury, forgery and use of forgery. The police officer on duty at the Medina A. Sow police station who had issued him a false certificate is being prosecuted for complicity of his bosses. The defendants dispute the facts.
