In brief:
  • A Lausanne saleswoman tried to blackmail her boss for 8,000 francs.
  • The boss had put his hand on his butt during working hours.
  • The court sentenced the boss to a fine of 300 francs, suspended.
  • The seller was convicted of attempted coercion.

It’s a safe bet that towards the end, the atmosphere should not have been so cordial in this Lausanne store. For having wanted to kill her boss, who had a wandering hand, a saleswoman is convicted by the Vaud courts for attempted coercion. His attacker does not escape sanctions either. He was found guilty of inconvenience caused by being confronted with a sexual act.

The events took place at the end of 2023 in a store in the city center. For more than a month, the boss had adopted a habit that was inappropriate to say the least. He tapped his employee’s left buttock at the end of the day, “with his right hand” specifies the criminal order of the Public Prosecutor’s Office, and told her that she could go home because she had finished her shift. The saleswoman finally filed a complaint, not without having previously tried to take advantage of the situation.

A silence for 8000 francs

The employee sent messages to her lecherous boss via WhatsApp messaging. They were unequivocal. The first said: “I filmed everything, either we work it out between us, or I file a complaint and tell your wife. I’ll let you think.” Another: “You touch my butt. You try to kiss me by force, we either work it out between us or I file a complaint.” The request then becomes more explicit: “You give me a ticket and I keep silent, or else I hire a lawyer.” The saleswoman then puts a price on her silence: “It’s 8,000 francs and I don’t say anything and I leave.”

The boss does not react to the blackmail of his employee. The next day, the seller’s sister takes over. Also on WhatsApp, she threatens to make his life “hell”, that in the absence of an arrangement, he will be taken to court and that he will lose everything. The same day, a mysterious lawyer contacts him. He tells him that criminal proceedings are underway and that it would be better for him if an agreement was reached. Finally, it’s the saleswoman’s brother-in-law who puts a little pressure on her. No doubt the last straw for the boss who, despite the threats, refuses to give in. He in turn files a complaint.

Both guilty

The court found the boss guilty. He received a fine of 300 francs with a two-year suspended sentence. He must also pay the costs of the procedure in the amount of 2,470 francs. The seller was sentenced to a monetary penalty of 1,800 francs, also suspended for two years. The procedural costs payable by him amount to 1,250 francs.
