In accordance with Law No. 2014-17 relating to the declaration of assets, there has been a rush by the new authorities at the National Office for the Fight against Fraud and Corruption (Ofnac) to file their assets.

According to sources who spoke to our colleagues at Walfadjri, several personalities, including ministers and general directors, have fulfilled this requirement. “They are coming at an exceptional pace. Some came very early, thus respecting the three-month deadline following their appointment,” confided a source without citing names. “The pace is satisfactory compared to what we were used to seeing.”

According to Article 2 of Law No. 2014-17 relating to the declaration of assets, the President of the National Assembly, the First Quaestor of the National Assembly, the Prime Minister, the ministers, the President of the Economic, Social and Environmental Council, all credit administrators, revenue and expenditure authorizing officers, public accountants, carrying out operations involving an annual total greater than or equal to one billion CFA francs are subject to this requirement.

These persons must, within three months of their appointment, “formulate a certified, accurate and sincere declaration of their financial situation concerning in particular their own property as well as, where applicable, those of the community or property deemed undivided under Article 380 of the Family Code”. “These assets are estimated on the date of the event giving rise to the declaration, as in the case of inheritance tax. The same obligation applies within three months of the cessation of duties, for reasons other than death. However, no new declaration is required from the taxable person who has established a declaration of his financial situation less than six months ago under the conditions provided for by this law”, writes the legislator.
