In a resounding verdict, the Diourbel court acquitted Mame Thierno Ndiaye, accused of fraud involving 3.1 million CFA. The case, which held the town of Touba in suspense, took a spectacular turn when the defense lawyer, Me Assane Dioma Ndiaye, managed to obtain the annulment of the investigation report, reported in the columns of AS.

Mame Thierno Ndiaye, a 36-year-old businessman, was accused by Nogaye Dièye, who had paid him 3.1 million CFA to take his son to the United States. At the bar, the prosecutor requested a sentence of two years, one of which was firm, while the civil party demanded substantial damages. However, even before the debates began, the defense highlighted “perfect violations of the defendant’s rights”.

According to L’AS, Me Assane Dioma Ndiaye pointed out prolonged police custody without notification to the prosecutor, which constitutes an infringement of legal procedures. “This situation is incomprehensible. My client gained nothing from this transaction. He may have failed, but that does not constitute fraud,” argued Mr. Ndiaye. The argument hit home. The court agreed to release Mame Thierno Ndiaye, considering that the procedure was not regular.

The ruling caused a mixture of relief and astonishment in the courtroom, with major implications for understanding the rights of defendants. The AS emphasizes that this case highlights potential flaws in judicial investigations. For Nogaye Dièye, the outcome is far from satisfactory, but for Me Ndiaye, justice prevailed.
