During his appearance on the Grand Jury program on RFM, Ismaïla Madior Fall, former Minister of Justice, spoke about the threats of legal proceedings against former President Macky Sall. Responding to calls from some to try the former head of state, Fall spoke of constitutional limits.
“We cannot judge him for acts he allegedly committed in the exercise of his duties. The principle is irresponsibility, except in cases of high treason,” he declared, referring to article 100 of the Senegalese Constitution. According to this article, the responsibility of a president in office can only be engaged in the event of high treason, and this would require a rigorous investigation to establish the facts constituting this serious offense.

Ismaila Madior Fall also underlined the collective dimension of recent events, marked by calls for insurrection and demonstrations from the opposition. “This is a shared responsibility between the executive and the opposition. If the state had not reacted, the country could have descended into chaos, even risking a military coup,” he warned.
To ease tensions and avoid an escalation, Fall advocates the path of “reconciling justice”. This approach, according to him, would make it possible to turn the page while recognizing errors, in order to preserve the stability of the country and safeguard its democratic institutions.

The former minister concluded by recalling that the State was protected and that democracy was preserved. “It is time to opt for a peaceful solution, which ensures the security of the country and its citizens,” he insisted.
