ADOR filed for an injunction to prohibit NewJeans members from signing advertising contracts independently without going through the agency.
According to ADOR's Jan. 13 filing, the agency recently submitted a request for an injunction to the Seoul Central District Court. This injunction seeks to prohibit NewJeans members from signing independent contracts with brands while they are under contract with ADOR.
The agency announced:
“Last week, ADOR filed an injunction with the Seoul Central District Court to “preserve the agency status and prohibit the signing of independent advertising contracts.”
This injunction aims to confirm ADOR's status as a management company under the exclusivity contract until the first trial of the confirmation of the validity of the exclusivity contract filed on December 3, 2024. It also aims to prevent NewJeans members to independently enter into advertising contracts or engage in promotional activities without the consent of ADOR.
The reason for filing this injunction is to avoid confusion and harm to third parties, such as advertisers, because NewJeans members, who unilaterally declared the termination of their exclusivity contracts, continued to contact advertisers independently.
ADOR believes that members' unilateral termination of exclusivity contracts is unfair, a claim it will prove through its ongoing lawsuit. However, because the final decision may take considerable time, the agency filed this injunction as an urgent measure to avoid continued confusion and harm.
This injunction reflects ADOR's intention to work with NewJeans. If members' independent activities continue, it could harm the value of the NewJeans brand, our only artist, and lead to a management crisis for ADOR.
If a precedent is set where artists can unilaterally terminate their contracts and independently engage in entertainment activities without legal procedures, it will discourage investment in the entertainment industry, destabilize the K-pop market and significantly reduce its growth. »
Currently, the NewJeans defend the idea that their contract with HYBE and ADOR is no longer valid and that they are now free, a version contested by the two companies who persist in saying that the contract is still valid.
