Convicted of plagiarism for “On va s’aimer”, Montagné and Barbelivien appeal to the Court of Cassation

WITHOUT INFRINGEMENT – The duo must pay 30,000 euros in damages and waive royalties on the song

They are determined to go “to the fight”: condemned by the Court of Appeal for the supposed plagiarism of the song A Girl from (1976), by Italian Gianni Nazarro, singer-composer Gilbert Montagné and lyricist Didier Barbelivien will challenge this decision in cassation, they told Le Parisien.

If Gilbert Montagné refuses to comment on a “case that is still in judgment”, Didier Barbelivien shared his “disbelief”: “There are no words in common in the two songs, and I am well placed to know that since I I am co-author of the complaining song,” he asserts.

Only the “musical” chorus would be affected

The texts of the two songs actually have no link, only their choruses are musically close, confirms Le Parisien. The lyricist’s lawyer also points out that “Italian justice has condemned them for a partial infringement which does not concern the texts”.

But if Didier Barbelivien clears himself of any plagiarism, he joins the cassation appeal launched by Gilbert Montagné’s lawyers… perhaps because his copyrights have been blocked on the two songs since an Italian decision in 2015?
