A political and administrative crisis that is getting bogged down

The town of Sornéville near Lunéville (54) is going through an unprecedented institutional crisis. For three years, no budget has been voted by the municipal council, plunging the city into a perilous administrative situation. This paralysis, which endangers the functioning of local public services, is explained in particular by the opposition's refusal to participate in the budget vote, against a backdrop of serious accusations of corruption.

Unexploited legal remedies

However, the legal framework provides clear solutions to this type of blockage. Article L1612-2 of the General Code of Local Authorities gives the prefect the power to intervene by contacting the regional chamber of accounts to establish a draft budget. In the absence of regularization, the prefect can even directly impose a budget to guarantee the continuity of the public service.

A case that takes a legal turn

The AC association!! brought the matter to justice by filing a report with the Public Prosecutor. The Public Prosecutor's Office is currently investigating serious suspicions of corruption, giving a new dimension to this initially budgetary crisis. The ongoing investigations explain the firm position of the municipal opposition.

Possible sanctions

Faced with this critical situation, more radical measures could be considered. Article L2122-16 of the General Code of Local Authorities provides for the possibility of dismissing the mayor for serious misconduct or poor management. The repeated inability to pass a budget could constitute sufficient reason to justify such a measure, while the inhabitants of Sornéville are growing impatient and awaiting concrete responses from their elected officials. Or the prefect.
