Bernabé stamps his feet in his box. He is eager to express his remonstrances about justice. The 32-year-old man is suspected of having shot point blank on a another man on the night of March 3 to 4, 2020 in Évry-Courcouronnes (Essonne). Initially sued for attempted murderbefore the facts are reclassified as aggravated violence, he has appeared on Tuesday December 17, 2024 before the 6th criminal chamber of the Évry-Courcouronnes judicial court.
The defendant's phone found at the scene of the tragedy
He was almost one o'clock in the morning, the night of the tragedy, when the firefighters were called for an intervention in a street in Évry-Courcouronnes. They take care of a victim who has received a bullet in the chest.
The police arriving on site made the first observations. Officials find a cell phone on the floor. The research will lead them to Bernabé, who is the owner.
In the phone, some contacts make them think that the accused would be wet in a trafficking in stolen cars.
The victim never named her attacker
The victim, Ba, is very unfavorably known police services. He is now in prison awaiting trial for attempted murder of his brothers.
At the material time, he does not name his attacker, walled in a law of silence which often applies in this type of case.
But the judge in charge of the investigation continues her investigations against the advice of the prosecution who requested a dismissal of the case.
“I have no connection with the victim” assures the accused
At the audience, Bernabé who passed ten months in pre-trial detentionproclaims his innocence, gives advice to the court, which will earn him reprimands from the president.
“I have no connection with the victim as the investigation demonstrated. I've never been interested in cars anymore, it's astonishing,” the defendant loses his temper.
The thirty-year-old already been convicted five times, but for facts far removed from those for which he is being prosecuted in this case.
“No certainty that the accused is the author of the shot”
The prosecutor did not hide this during her requisitions: “We are facing a case where the truth has been concealed. No witnesses, very thin evidence, no DNA on the scene, a civil party absent from the proceedings, we have no certainty that the defendant is the author of the shot” by requesting his release, which is not common.
It was followed by the court. Bernabé thanked the court before leaving for a new life in the Clermont-Ferrand region.
