A man was found guilty of violence against his ex-partner by the Nice judicial court this Friday, December 20. He received a prison sentence of 18 months, six months suspended.
A man was sentenced to 18 months in prison, six of which were suspended and required treatment, for acts of violence against his ex-partner, in Nice, this Friday, December 20.
The accused was found guilty of the facts which occurred this Wednesday, December 18. During his immediate appearance, he admitted the facts, which during his hearing he declared to be “slaps” then described on the stand as “beatings”.
“I didn’t know where I was anymore”
This Wednesday, the municipal police were called during the afternoon following a report of violence. The man was then arrested, alone on board. He said he wanted to go with his partner to the police station, but allegedly turned around.
He was placed in police custody while the victim was interviewed. She declared that she had been separated from the individual for 10 years, since the birth of their son, whom she said she saw occasionally because the accused has sole custody of him.
During this hearing, she declared that her former partner “beat her up in front of everyone” and that she almost lost consciousness. “I didn’t know where I was anymore.” Despite the nature of the facts described, the victim did not file a complaint.
A witness reports two punches
Although no video surveillance image supports the facts, a witness, contacted by telephone by the municipal police, reported having witnessed a scene of violence. According to him, the man punched the victim twice in the stomach before forcing her into the vehicle.
This Friday, during the hearing, the defendant explains that the victim went to his home this Wednesday, where his mother lives. The dispute was over their child. “She tried to break a window,” he recounted during the hearing, adding that she had already set fire to a trash can in the residence.
According to the accused, these actions were intended to break into his home where their child was. “I got angry at the time, I lost my temper. I punched her in the face and put her in the car.”
“A form of control or fear”
The victim, who did not appear at the hearing, receives a disabled adult allowance due to psychological disorders. “In view of the procedure, we can suspect a form of control or fear,” argued the prosecutor, who had requested 24 months of imprisonment with a committal warrant and a ban on contact with the victim for three years.
Requisitions considered severe by the defense, who stressed that the accused had no entry in his criminal record reporting violence. For a time, the hypothesis of violence using his vehicle was raised, which the investigation will ultimately rule out.
