“All the accused were unaware of Gisèle Pelicote’s state of chemical submission”
The aggravating circumstance of rape or attempted rape “in a meeting” remains applied to all of the accused. On the other hand, the second aggravating circumstance, that of “administration of substance”, is not taken into account. This indicates that the court believes that all the accused were not aware of Gisèle Pelicot’s state of chemical submission.
