The question of the day. Would you be ready to join a “Yellow Vest” union?

The “Yellow Vests” union is considered to be a trade union organization eligible to participate in the ballot relating to the measurement of the audience of trade union organizations among employees of companies with fewer than eleven employees, at the national and inter-professional level estimated the judicial court in its decision.

The union election for employees of Very Small Businesses (VSEs) and individual employers will be held from November 25 to December 9, 2024. It plays a determining role in the representation of employees, the negotiation of their working conditions and the defense of their rights.

These elections are also important for the distribution of industrial tribunal seats between the trade union organizations.

According to article L. 2122-10-6 of the labor code, trade union organizations which respect the criteria of respect for republican values, independence and financial transparency, legally constituted for at least two years and to which the statutes give vocation to be present in the geographical field concerned, as well as unions affiliated to a representative union organization at the national level and interprofessional can be candidates for professional elections.

For the CGT-FO, CFE-CGC, CFTC and UNSA unions, the USGJ contravenes respect for republican values ​​through the regular violence of its remarks and the illicit nature of its actions according to the arguments of its representatives in court. They want it as proof the threatening character yellow vests in certain writings, with regard to specifically designated deputies who voted for the law on the management of the health crisis and requiring vaccination .

Long series of decisions

For the court, if these writings contain an unpleasant ambiguity about the intentions of their author, it cannot be assumed that the latter intended to resort to violent action .

The CGT also maintained that the USGJ, which is an extension of the eponymous political movement whose heritage it claims, has only very marginal activity around the representation of the interests of employees .

The requests of the CGT, the CGT-FO, the CFE-CGC, the CFTC, the UNSA and the CFDT tending to declare that the USGJ is inadmissible to stand as a candidate in the ballot which will be held in companies with fewer than 11 employees, were thus rejected by the courts.

This new decision rendered Monday is the last in a long series, begun in March with the opinion of the Director General of Labor authorizing the Union Syndicale des Gilets Jaunes to present itself.
