Family lawyer points to ‘particularly dangerous’ road

A 7-year-old child named Kamilya was violently hit by a motorbike in Vallauris, in the Alpes-Maritimes. Her vital prognosis is “very engaged”, according to the Grasse prosecutor’s office. Her family’s lawyer questions the responsibility of the municipality.

A family seeks justice. The lawyer for the relatives of Kamilya, the 7-year-old child who is between life and death after being hit by a motorcycle on Thursday, August 29, is calling for a thorough investigation, pointing to the city’s possible responsibility in this tragedy.

“Mayors have special responsibilities with their administrative police powers, which include road safety. The courts must ask themselves whether the City has taken the right measures on this road,” said Nabil Boudi on Sunday, September 1, to Nice Matin.

The lawyer does not, however, only point the finger at the municipality, but calls for questions about shared responsibility in this accident. “There could be several perpetrators,” he emphasizes, while being questioned about the role of the departmental council.

An “accident-prone” road

Preferring not to speculate on the potential liability of the motorcyclist – “the presumption of innocence applies”, he recalls – Maître Nabil Boudi underlines the dangerousness of the road on which the accident took place.

“All the people of Vallauris know that it is particularly dangerous. They clearly describe it as an accident-prone area,” he proclaims.

“Why wait for such a tragedy to happen to consider measures? Other children have been affected. The tragedy that affected Kamilya is not an isolated one,” laments the lawyer.

The mayor of Vallauris, Kevin Luciano, has already assured BFMTV that “developments” were being considered on this road by the municipality and the department. “This is not the trial of a road, it is the trial of an individual,” he had also added, however.

A petition has also been launched by residents of the commune, demanding “road safety measures in Vallauris” on the road in question. It had collected more than 2,500 signatures this Sunday.

A family “at Kamilya’s bedside”

While a few days have passed since the tragedy and Kamilya is currently in an artificial coma, Maître Nabil Boudi assures that his family is “at their daughter’s bedside” and already “grieving”, while her father had said he was pessimistic about her vital prognosis.

Their lawyer assures that Kamilya’s parents have “only one obsession: justice”. “The family is asking for an effective and serious investigation,” he assures.

A suspect is under examination

The suspect, who was charged, was released on Saturday, despite the prosecution’s demands and the favourable opinion of the investigating judge in charge of the case.

He is required to “report once every two weeks to the Antibes police station” and is prohibited from going to Vallauris or “coming into contact with the victim of the offence, his parents, brothers and sisters in any way whatsoever”.

He also had to hand over his driving licence to the court registry and is banned from leaving the Alpes-Maritimes department. The prosecution said it had appealed this decision.

“The family is dismayed” that the driver was not placed in pre-trial detention, explained to AFP Me Nabil Boudi, who for his part believes that “the appeal will be studied, generally within 10 to 15 days”.

After this decision, Kamilya’s father made virulent remarks this Sunday on his Facebook page, accusing the French justice system of laxity. “Starting tomorrow, citizens who have not been arrested in the act know that they can drive as they please, act crazy on the road, kill. No respect for our daughter or for ourselves,” he denounced.
