Dakar, Jan 16 (APS) – The theme of the solemn re-entry of the Courts and Tribunals, which is being held this Thursday, ”Right to strike and preservation of public order”, is a subject which will always be relevant in the working environment, estimated the Labor and Social Security inspector, Oumar Fall.

”This is a problem that will always be present in the field of professional relations,” he declared.

The Executive Secretary of the High Council for Social Dialogue spoke thus in an interview with the APS, as a prelude to the solemn hearing for the return of the Courts and Tribunals, which is being held this Thursday.

This ceremony, which marks the start of the 2025 judicial year, is held at the Supreme Court, under the presidency of the Head of State, Bassirou Diomaye Faye, president of the Superior Council of the Magistracy, in the presence of the vice-president of the Superior Council of the Magistracy, Ousmane Diagne, Keeper of the Seals, Minister of Justice, senior officials of institutions of the Republic, among others.

According to the Presidency of the Republic, the choice of theme highlights the need to reconcile respect for the constitutional right to strike with the requirement to preserve public order.

The right to strike is inseparable from freedom of association enshrined in international laws and conventions, but, warns Oumar Fall, if its exercise “is in itself beneficial, those who use it should not abuse it at the risk of compromising others constitutional rights of other citizens.

Social movements as well as political or legal power have contributed to the advancement of workers’ rights, observes the executive secretary of the High Council for Social Dialogue.

”Advances in social progress can certainly result, in part, from the unilateral desire of the legislator or public authorities to promote social justice by providing for provisions which improve workers’ rights,” he notes.

”But many of the rights enjoyed by workers were acquired after strike movements, which they launched following professional demands,” adds the Labor Inspector.
