Assassination in Geneva: defense denounces prosecution investigation

In the case of the assassination of an Egyptian diplomat in Geneva in 1995, the lawyer of the main accused denounced Thursday an investigation carried out solely against him and the work of the Federal Police. He found acquittal for the murder and rapes.

(Keystone-ATS) The defender tried to clarify the “suffocating portrait” of his client drawn up by the psychiatric experts and the federal prosecutor. He spoke of a complex man, capable of lying but also of frankness, to whom “many people remain attached”, despite everything.

The first days of the investigation were discussed at length, in particular the circumstances in which the accused uttered the phrase “the technique caught up with me”, which was subsequently denied by the person concerned. It was a “little lie”, as his client can tell, explained the lawyer, but the Federal Police (Fedpol), who wanted to build a case against him, interpreted these words as a confession.

Weird but not overwhelming

In the same spirit, the accused’s “bizarre” explanations should not be taken literally, argued the defender. “He clumsily seeks to exculpate himself” but they are not overwhelming.

The use of DNA traces found on the homemade silencer used during the crime has been strongly criticized. The expert reports are full of inaccuracies and the mixing of the DNA of six different people, including those of the accused and his friend at the time, has not been explained. “Everything is just a flaw in the assessment of the traces,” summarized the lawyer. Scientific proof is not provided. »

The scenario of a homicide on command is considered completely fictitious. Why other avenues were not explored, the lawyer wondered. Like that of a colleague who allegedly did it. »

Other contested offenses

Turning to the rapes denounced by an ex-partner, the defender considered that the ambiguous behavior of the latter was not understandable to his client. The relationship, certainly chaotic, continued for ten years, with ups and downs. “There were no rapes,” he concluded after citing numerous intimate messages sent by the victim to the accused.

The lawyer also tried to reduce the scope of the violence alleged. “They didn’t happen every day or every week, but only a few times. » These acts alone would not have made it possible to break the complainant’s resistance.

The accusations of rape would therefore reflect a “collapse” of the victim, due to the failure of the relationship and her hopes. Under these conditions, the accused could not perceive a clear refusal from his partner.
