Family code reform project: the government postpones the meeting of the justice committee

The meeting of the Committee on Justice, Legislation and Human Rights, initially scheduled for Tuesday January 7 at 3 p.m., has been postponed to a later date at the request of the government. This meeting was to be held in the presence of the Minister of Justice Abdellatif Ouahbi and that of Islamic Affairs, Ahmed Toufiq, in order to present to the deputies the main proposals for revising the Family Code.

In a note addressed to the members of the commission, the president of the commission, Saïd Bâaziz, officially announced this postponement, explaining that it concerned the examination of the theme: “The main lines of the revision of the Family Code. »

This postponement comes after several components of the opposition had expressed their wish to organize this meeting. During the weekly parliamentary session of the previous Monday, Idriss Sentissi, president of the People’s Party (PP) group in the House of Representatives, urged the government to enlighten public opinion on the new developments envisaged as part of this revision and to put end the rumors and erroneous interpretations circulating.

On December 24, 2024, the government presented the main planned modifications, with a view to overhauling the Family Code. Among the proposed changes are provisions affecting controversial issues such as inheritance, divorce, child custody and polygamy. Furthermore, restrictions on “Quranic marriage” have been put forward as well as setting the legal age of marriage at 18 for girls and boys.

The government is currently working on the preparation of a global reform project of the Family Code in accordance with the recommendations of the Superior Council of Ulemas. This text, once completed, will be submitted for approval to the Governing Council before being transmitted to Parliament. This will have to examine it first in committee, where amendments can be made, then in plenary session for adoption.

The project will then be examined by the Chamber of Advisors according to the legislative procedure in force. In the event of amendments introduced by this second chamber, the text will return to the House of Representatives for a new reading. Once the legislative process is completed, the revised Family Code will be published in the Official Bulletin, thus marking its entry into force.
