: a gendarme convicted for falsifying his daughter's date of birth – LINFO.re

The gendarme received a sanction of 90 day fines at the rate of 10 euros per day, as well as a ban on running in an election for two years.

Backdated birth for financial benefits

And constable in was convicted of changing his daughter's marital status in order to reduce her taxes. The affair began in January 2022, when his wife gave birth at home. The child was born on January 1, 2022, but the father declared his birth on December 31, 2021. This change would have allowed him to benefit from tax and educational advantages.

It is the midwife who, while returning to look for a forgotten object, discovers the falsification. She then went to the gendarmerie operational center to explain the situation. A recorded conversation confirms the true date of birth.

A two-stage trial

Initially, the gendarme denied the facts and was sentenced at first instance in November 2023 to two months in prison. The court also banned him from holding public office for two years.

On appeal, he ended up confessing. On December 16, 2024, his sentence was reduced to 90 day fines of 10 euros and two years of ineligibility. Additionally, the conviction will not appear on his number two criminal record, which preserves his military status.

A serious fault despite a paltry motive

Faced with the judges, the gendarme admits to having made bad decisions without measuring the consequences. The general advocate, Caroline Gaziot, indicates that modifying a civil status is serious, especially for a gendarme. She also mentions another case where he consulted a file for his sister-in-law.

The gendarme could have permanently lost his rank, the deprivation of civil rights leading to radiation. However, the absence of an entry in the criminal record allows this incapacity to be lifted. He is committed to regularizing his daughter's civil status.
