The revision of the legislation concerning notaries is on the table of the Jura Parliament. The Government sent this Thursday to the legislature a message relating to this overhaul which aims to adapt the current law which turns out to be outdated and, in part, obsolete, according to the press release sent this Thursday. It also makes it possible to concretize a motion tabled in 2018 by the socialist Loïc Dobler who asked to review this legislation and the prices of the sector.
At the end of the consultation, the basic principles proposed by the Government for the revision of the law and the determination of new fee rates were generally well received by the organizations. In fact, the maintenance of the independent notary, the modernization of the surveillance system and the new regime concerning ancillary activities have not been contested.
Concerning the rates, the maintenance of the ad valorem rate, that is to say the rate in which the remuneration is fixed according to the value of the share, is not called into question. The overall reduction in prices, the raising of minimums, the introduction of ceilings and the lowering of those that exist have not made people flinch either. The monitoring which serves to evaluate the effects of the transition for certain acts from the ad valorem tariff to a tariff in the form of a range has sparked some criticism from the circles concerned, but it will be maintained in the project submitted to Parliament.
