Alcohol and personality disorder
The perpetrator is psychologically unstable. She suffers from a borderline personality disorder, accentuated by regular alcohol consumption.
His lawyer, Me Thirion, pleads for acquittal on the basis of article 71 of the Penal Code. This provides that there is no offense when the defendant was suffering, at the time of the facts, from a mental disorder which completely abolishes his capacity for discernment. “She knows she shouldn’t drink, but it’s precisely this behavioral disorder that leads her to use.”

Conversely, the policewoman’s lawyer, Me Meurice and the Namur public prosecutor’s office believe that the cause of justification invoked is not involved.
“This lady is afraid of rejection, abandonment and puts herself in danger to be appreciated. This personality disorder is different from a mental disorder”explains Me Meurice, lawyer for the policewoman. An expert writes it in a report. “On the day of the incident, she bought two bottles of vodka as soon as she left Beau Vallon. She knowingly put herself in this state of alteration”continues the Namur public prosecutor’s office. The latter requires one year in prison with a probationary suspension.
The judgment will be pronounced on January 10.
