How can we find each other drunk and driving at 8:40 in the morning? This is the question that a 60-year-old night watchman had great difficulty answering, this Monday, December 2, 2024, at the correctional hearing from Melun, in Seine-et-Marne. He appeared for manslaughter occurred on January 2: his relatively advanced alcoholic state – a bottle whole rosé according to the prosecutor – had caused death of another road user who was traveling by bike on the small departmental road linking Verneuil-l'Etang to Guignes.

One was leaving work while the other was going there. They were traveling in the same direction when the cyclist, aged around sixty, was hit from behind at a speed of around 75 km/h. Polytraumatized and suffering from skull injuries, he had been helicopter towards the Henri-Mondor hospital where he remained two months in intensive carebefore succumbing to his injuries.

“I didn’t see anything”

In the court room, his widow, a civil party, had to relive this terrible drama by reading the various testimonies. At the bar, the defendant, under judicial supervision, struggles to explain himself almost a year after the events. “I didn’t see anything,” he stammers. In fact, no sign of braking no steering wheel impact but a “full frame” shock, as evidenced by the sunken metal sheets and the star-shaped windshield of his Laguna.

Concerning his blood alcohol level, he explains that he had a break that night, with a “ gourmet basket» that had just been offered to him a few days earlier for Noël. All alone in the large grain silos of the Brie Cooperative, he ended up drinking the entire bottle of rosé from the package before leaving his post. His victim was perfectly fasted but on a bike without lights. The examination showed that he was driving in the middle of the road.

Under electronic bracelet

A previous case of drunk driving does not plead in favor of the motorist against whom the prosecutor requested four years in prison, two of which are closed. A sentence that the defense lawyer, M^e Clarisse Scialom, will succeed in reducing two yearsincluding one year suspended, the farm part being convertiblesous bracelet.
