senator Jean-Michel Arnaud summoned to the court for a dispute with the town hall of Lettret

The municipality criticizes the senator for using a garage that has been in his family since 1888. Jean-Michel Arnaud believes he is the owner of this shed while the Lettret town hall assures that this property does not appear in the land register and that it is located under a municipal road.

Jean-Michel Arnaud, senator from Hautes-Alpes, is summoned before the judicial court on Tuesday, December 10, BFM DICI has learned. According to our information, the elected official must defend himself in the context of a dispute between him and the town hall of Lettret.

Under a municipal road

In question, a garage, or rather a barn or agricultural shed used for many years by Jean-Michel Arnaud. Located on the edge of departmental road 942, the place is located below a municipal road, on rue de l'Église.

“This garage is not registered and is, in our opinion, located in a public space because it is under a municipal road. Jean-Michel Arnaud holds the key but is not the owner. The law seems clear. Unlike the private domain that can be held without title after 30 years, the public domain is imprescriptible”, defends Rémy Oddou, the mayor of Lettret.

But what is the point of wanting to recover an old, outdated barn that has belonged to the Arnaud family for decades? “This will give us a place to store. In addition, this garage is located under a municipal road, it has an arch and the passage of a municipal pipe. We therefore have every interest in recovering it,” concludes the councilor.

“It’s no business.”

But for Jean-Michel Arnaud and his lawyer, Maître Nicolas Wierzbinski, this speech does not hold up. The public and obvious detestation between the mayor of Lettret and the former mayor of Tallard is simply on the verge of a new episode.

“For us, it's not a matter. I wonder if the commune of Lettret would have initiated this procedure if Jean-Michel Arnaud was not the owner of this shed”, asks the lawyer of the senator.

And to continue: “my client did some research and it turns out that this shed has belonged to his family since his great-grandfather, on July 29, 1888. We obviously have the deeds. Since that date, it has been his family who owns the shed which was already in the same configuration at that time”, explains Maître Nicolas Wierzbinski.

“Once, it was even the commune of Lettret which sent a contractor to the owner, my client, to strengthen a wall near this shed. This place has been owned from father to son since 1888. It is a well maintained and my client is extremely surprised by the existence of this procedure”, concludes Jean-Michel Arnaud's lawyer.
