Mwith their hands in their pockets or their arms crossed, the defendants at the immediate appearance hearing on Monday, November 25, do not really seem to understand the seriousness of their actions, Libourne. On November 14, however, they attacked, in front of his home in Laruscade, Jean-Louis, a dashing septuagenarian who, every day, has his little ritual of walking; who, every day, wear his flashy rings, without suspecting that one day they would make him a target.
Spotted in a tobacco bar
That day, by chance, Benjamin Cognet stopped at the tobacco bar L'Inattendu in Cavignac to buy cigarettes, and crossed paths with the septuagenarian. “Her jewelry was very visible. It’s the lure of profit,” confides the latter, who would have spoken about it to another sidekick, Matthieu Gicquel. An hour later, the victim returning home was pushed in the back and fell face down. A shoe crushes his hand, another part of his face. Several of his rings, including a bangle with a ruby, but also two chains, a bracelet, his bag with his phone, 150 euros and two gold watches, were stolen from him, before he was gassed. Amount of damage: approximately 30,000 euros. The septuagenarian suffers from multiple wounds, some of which are raw, and had to have a few stitches placed in his right eye. Fifteen days of ITT are issued to him.
“He was driving but he didn’t know anything. We told him to turn right, turn left but he saw nothing of the attack”
During the hearing, the judges mainly sought to determine the role of each person. Because if the victim mentions two attackers, the video surveillance cameras, which made it possible to discover that she had been followed, spotted four occupants in the vehicle. Three of them appeared in court on Monday. All repeat offenders, including Damien Assensi who between the ages of 16 and 27 spent less than six months at large. He is now 29 and was already in pre-trial detention in connection with another case. The fourth is in nature.
“Not credible” explanations
Benjamin Cognet and Matthieu Gicquel, 27 and 20 years old, both from Cognac, explain that they came to Haute Gironde to meet Damien Assensi and one of his acquaintances for a car sale. “He wanted to try it, he was driving but he didn't know anything about it. He was told to turn right and left but he saw nothing of the attack. It was just the two of us,” say the Cognaçais. “Didn’t these maneuvers seem strange to you?” », asks the judge to Damien Assensi. “Well no. I didn’t know the sector…”
For Deputy Prosecutor Élodie Blier, this car sale out of the hat at the hearing is not credible. Just like the feigned ignorance, according to her, of Damien Assensi, “whose pedigree allows him to know that, in this type of misdeed, it is better to stay in the vehicle. Above all, he couldn't ignore what was happening. » The court fully followed its requisitions. Or five years in prison for Damien Assensi and Benjamin Cognet, and three years for Matthieu Gicquel, all accompanied by a ban on coming into contact with the victim and appearing in Laruscade for three years.
