She denounced “risk for populations” of being “exposed to electromagnetic fields”. There maire (various right) from Breuillet (Essonne) Véronique Mayeur who was opposite has l’installation of a relay antenna on the parking of a centre commercialhas been disowned speak summary judge of administrative court of Versailles.
The manufacturing company defends an “emergency”
The company Next Tower had in fact taken legal action on September 19, 2024 to have the veto that the city councilor had opposed to it on May 6, 2024: there was “urgency” to suspend it in view of “the public interest linked to the coverage of the national territory”.
Society indeed has “obligations” vis-à-vis the Regulatory Authority for Electronic Communications, Posts and Press Distribution (Arcep) regarding coverage of the national territory by mobile telephone networks.
The project must also “contribute to the coverage” of Breuillet by “improving the coverage of the 4G network” and implementing the 5G network “non-existent to date”.
“Partial and degraded” coverage
In this town of 8,900 inhabitants, “the quality of service remains mediocre to this day for calls and SMS as well as for internet connection,” certified Next Tower.
By producing “a simulated coverage map of the mobile telephone network”, Next Tower demonstrates that the sector in question only has “partial and degraded” coverage, confirms the summary judge of the Versailles administrative court in a order of October 1, 2024 which has just been made public.
The installation “will make it possible to cover areas currently not satisfactorily supported” and the planned site “will make it possible to fill a coverage gap”, he thinks while considering the emergency condition as “met”.
No element likely to establish a risk for populations
On the merits, “it does not result from the investigation of any detailed element likely to establish the existence of a risk for populations resulting from their exposure to electromagnetic fields emitted by mobile telephone relay antennas,” considers the magistrate.
The commune of Breuillet, for its part, criticized “the lack of respect by the Next Tower company for a duty to pool existing installations”although provided for by the Postal and Electronic Communications Code.
But “it is clear that this article does not impose no obligation to share sites or pylons between the operators”, reframes the summary judge of the administrative court of Versailles.
In the end, the magistrate therefore issued an “injunction” to the mayor of Breuillet to take “provisionally” a decision of “non-opposition” to this prior declaration work by December 1, 2024. The municipality will also have to pay €800 to Next Tower for its legal costs.
