The criminal court of Saint-Brieuc (Côtes-d’Armor) studied, Thursday November 21, 2024a matter which once again finds its origins in the excess alcohol.

The defendant, aged 51, has been addicted to it for many years. He hasn't seen a doctor in his entire adult life.

His long-term partner – they have two children in common – suffers from the same illness.

An eventful New Year’s Eve

The evening of December 31, 2022 in Haut-Corlay (Côtes-d'Armor) is no exception to the rule: the couple got drunk and the man became a little too enterprising. He forces his partner into a non-consensual sexual relationship.

The couple's daughter, returning from visiting friends, hears her mother several times: “Stop, let me go!” » She asks him to call the police.

When the soldiers arrive, around 3 a.m.the man is no longer there but he is quickly found in an outbuilding of the property. He is arrested and placed in police custody.

He has more than two grams of alcohol in his blood.

His partner is still at 1.6 grams mid-morning the next day.

Indicted for rape

The latter describes her attack but does not want to file a complaint : he's the father of her children, she still has feelings for him. He works on the horse breeding operation and helps with household chores.

Initially indicted for violthe facts were subsequently reclassified as sexual assault.

An apparent sobriety on both sides

At the bar of the criminal court, the defendant indicates that he is totally sober for several months.

The victim declares that he no longer consumes more than two beers per day.

The president tells him that their life together can only resume satisfactorily if they both remain abstinent.

He won't do it again, he's learned his lesson.

At the bar, the defendant freely admits the facts with which he is accused.

His psychiatric expertise indicates that behavioral outbursts remain possible if he found himself again under the effects of alcohol abuse.

The victim reiterates on the stand what she said during the proceedings and in front of a psychologist: their professional activity takes up a lot of their time, they have little left to discuss.

She indicates: “He will not do it anymore, he has understood the lesson“, she also confirms her wish to resume life together.

He's the love of my life.

A moment of relaxation

This then tears off laughter to all those present, including in court.

When her spouse's lawyer pleads, indicating that her client works on the farm and that her help is essential, the victim cuts her off: “I also need it for do the dishes ! »

The public prosecutor requests a sentence of 18 months imprisonment accompanied by a probationary stay with obligations of care, work and the follow-up of an awareness course on domestic violence, as well as its registration at FIJAIS (Sex Offender File).

After deliberations, the court sentences the accused according to the quantum of the sentence required but accompanied by a simple reprievewithout obligations. Registration with FIJAIS is pronounced.

The couple therefore leaves the court to resume life… and work together.
