Another exceptional municipal council. The elected officials of La Chapelle-Hareng (Eure) are summoned for a new assembly to vote again in favor (or not) of the merger project with Le Planquay and Thiberville, this Thursday November 21, 2024 at 7:30 p.m. .

The Eure prefecture requested a new vote after perfect equality (4 votes for, 4 votes against) obtained during the municipal council meeting on Thursday November 7, 2024, concerning the project to create a new municipality.
Indeed, the assembly of elected officials from La Chapelle-Hareng experienced two resignations and one deathwhich explains the even number of his advisors. In Thiberville, the elected officials present voted in favor of the project, just like in Planquay where only one elected official voted against.
At La Chapelle, the council – within which discussions were tense – took place in front of around ten inhabitants and a representative of Public Finance who came to present the results of a financial report on “the constitution of a new municipality on January 1, 2025”. This document concludes positively on this mergerfrom a financial point of view.
Before this second council in November, elected officials were invited to a meeting with the prefecture and the tax services.
The four elected officials who voted against the merger refused to go there, confirms one of them. “They were thinking of changing our minds before the council, but that’s not going to happen. » Like the first time, a secret ballot will be requested.
“We asked for it the first time, because the mayor's vote would have counted double in a public vote,” explains the latter.
According to article L2121-20 of the General Code of Local Authorities, “when there is an equal sharing of votes and except in the case of a secret ballot, the vote of the president is casting. »
A project that must be clear
On the side of state services, “it is important that the merger plan is clear », Indicates Philippe Fournier-Mongieux, sub-prefect of Bernay. The State, via its local representative the Eure prefecture, supports this project, but “we would like the elected officials who voted “no” are convinced of the project ».
Because what the state services are looking for is a consensus of all partiesas this new vote proves.
If the scenario of a tie is repeated this Thursday, November 21, 2024, “we will see what we do,” indicates the sub-prefect.
Among the possible scenarios, the prefecture could request a consultation with the inhabitants of the three municipalities, as enshrined in the law. Compared to the calendar, the creation of the new municipality could be more difficult, because the date targeted by the three mayors is that from January 1, 2025 (the start of the pre-election period when many projects are put on hold).
As a reminder, all municipal councils are open to the public, but they cannot intervene during their proceedings.
How is a new commune created?
According to the General Code of Local Authorities, the creation of a new municipality can be done via several means, including the validation of two thirds of the municipal councils of municipalities representing more than two thirds of the total population. As a reminder, the municipal councils of Thiberville and Planquay voted in favor of the merger of the municipalities. Unlike La Chapelle-Hareng which experienced a perfect tie.
According to data from the “financial analysis with a view to the constitution of a new municipality on January 1, 2025” and carried out by Public Finance, the total population is 2,086 inhabitants (127 for La Chapelle, 164 for Le Planquay and 1,795 for Thiberville). Thus, Thiberville – which already represents more than half of the population – by adding Le Planquay, two thirds are largely reached.
However, it is the State via the Prefecture of Eure which is guarantor of the project. The creation of a new municipality is the subject of a prefectural decree.
