On Tuesday, November 19, 2024, by not recognizing before the criminal court of Saint-Nazaire, that his “little pats on the buttocks were only encouragement to do better, even congratulations”, the former school director of Saint-Père-en-Retz, convinced no one.

Acts committed in 2010

It was only in 2021 that the young girl, now 24 years old, filed a complaint to the policefor facts which she places between September and December 2010, when he had placed his desk at the back of the class.

She said that when she went to correct exercises for him, he “ran his hand over her buttocks”.

At the time, one of her friends had complained, and claimed to have witnessed the actions of the teacher. But the victim denied the facts.

I was afraid, I wanted to protect my parents, I told them everything in September 2020.

She failed her license…

In fact, her parents, until then, did not understand why their daughter was having crying fits, suffering from anxiety, insomnia…

It was during a therapy session that she had a flash: “I remembered that, two years earlier, my girlfriend had told me that she had seen him slide his hands over my chest” .

Very sad, she adds: “Today I am in the last stage of my reconstruction ».

The consequences are serious for the complainant, as explained by Me Aurélie Fournard : “Her examiner looked like her teacher, she failed her driving test. Then, she was not able to practice her job as an accountant, because she could not be isolated in an office, she is currently a saleswoman.”

“No sexual intent”

At the helm, the school teacher, retired from 69 ansdoes not agree at all with what he is accused of: “I refute any caress, I only recognize little pats on the buttocks of both boys and girls”.

He specifies that if he preferred to put his desk at the back of the classroom, it was “for the needs of IT”.

If all the teachers who slapped the buttocks were prosecuted for sexual assault, there would be some. I don't see any sexual intent in my actions.

Me Fournard “strongly regrets this trivialization ».

The president explains that fourteen children having been heard, several received her little pats.

The complainant's girlfriend having given an important detail: “She was the most trained of all of us.”

Already convicted for similar acts

Knowing that he has already been condemned by the Court of Appeal of Rennes for similar facts, the prosecutor recalled the numerous hearings of students.

If the facts appeared “particularly worrying” to him, he explained “the suffering of the nine-ten year old girl, then in the middle of construction, and the discomfort that followed”.

The defense lawyer summarizes: “Two gestures, caresses on the chest, which the friend did not mention in her first statements, and the buttocks, with the little comment: 'you will do better next time, very good …’ is all we have.”

Me Manon Loarec continues: “There is no evidence that he intended to invade her privacy.” She pleads for release.

But the court does not follow it. It doubles the quota of the required sentence: eight months in prison with a simple suspended sentence.

The defendant is banned from any activity with minors for three years.

He will have to pay €2,000 in moral damage to the victim and €800 in lawyer fees.
