The authors have made around forty recommendations to the government and are also calling for a “Grenelle of sexist and sexual violence”.
“Too often men who have ascendancy through their hierarchy or through their power are in a position of domination which they abuse.” This is the implacable observation drawn up by a report submitted to the government, Monday, November 18, on sexist and sexual violence under relationships of authority and power. It was ordered in March by Aurore Bergé, at the time minister responsible for equality between women and men.
The subject is considered a “scourge ignored for too long” by the authors of the report: senior civil servant Christine Abrossimov, general secretary of the National Association of HR Directors Christine Caldeira, ex-tennis player Angélique Cauchy, ex-senator Bariza Khiari, gynecologist Marie-France Olieric and lawyer Rachel-Flore Pardo.
After nearly 70 hearings, they thus draw up 41 recommendations, including 15 “priorities in the world of work”and others in the specific areas of health, culture, sport and political institutions. These specialists also call on the government to launch a “Grenelle on sexist and sexual violence”. Franceinfo summarizes the priorities established on this occasion.
In the world of work
The report first proposes to condition public aid “the effective implementation of measures to prevent gender-based and sexual violence”. The authors also want to create a label “Acting against sexist and sexual violence” to distinguish proactive companies in this area and make training on the subject compulsory for “any person in a position of authority” and any person “intervening in the management of cases of gender-based and sexual violence”.
To better identify this violence, the mission proposes to “generalize listening and reporting structures”. On sanctions, the report urges the government to allow victims of gender-based and sexual violence, outside of a marital context, to request a protection order. It also suggests experimenting with the creation of specialized centers on gender-based and sexual violence in the context of work relations. All with a judge specialized in both criminal matters and individual disputes between employers and employees. Finally, it is particularly suggested to increase “the conditions of coverage by insurance or mutual societies” costs related to legal action and the care of victims of gender-based or sexual violence.
In the field of health
So that caregivers can effectively identify gender-based and sexual violence in the workplace, the report puts forward the idea of thinking about building a guide “good practices” emanating from the High Authority of Health, like what has been done for violence within couples.
It also proposes to supplement the Code of Criminal Procedure in order to allow medical associations to consult part of the criminal record of a caregiver, “as soon as the Order is alerted to facts likely to constitute a breach of ethical rules”. But also to access the fiautomated judicial file of perpetrators of sexual or violent offenses “at the time of registration and when filing a complaint”.
In order to better support victims, the mission wishes to reform the My psychological support system, by allowing “support by Social Security psychological follow-up for women victims of violence over several months”. They would also be followed by professionals specializing in psychological trauma.
In cultural and media circles
While the #MeToo movement emerged in the world of cinema in 2017, the report recommends, among other things, developing and better recognizing the profession of intimacy coordinator. On a set, his role is to ensure the well-being of the actors and actresses during sex or intimate scenes.
In the field of media, the authors draw this observation: “Arcom's field of control and incentive [le gendarme de l’audiovisuel] concerns the fight against sexist stereotypes, through the image of women in the media, rather than the phenomena” gender-based and sexual violence in the media. They therefore wish, ultimately, “assess the expansion of Arcom’s skills, means of investigation and sanction”.
In the world of sport
In this area, marred by cases of sexist and sexual violence, it is notably proposed to set up a team of coaches, if possible mixed, for a group of sports “in order to avoid a dual coach/trainee relationship”. But also to promote the accession of women to coaching positions and to set up “a strategy of identification, collection and freedom of speech by forming a referent in each sports structure” responsible for gender-based and sexual violence.
The report also suggests making the issuance of the professional sports card conditional on educators having undergone training in gender-based and sexual violence. He also mentions the idea of harmonizing the penalty scales between sports federations.
In political institutions
Aimed at political institutions and local authorities, the mission is intended to be just as ambitious. She suggests booking “a fraction of the financing of political parties in the assemblies” respect for the fight against sexist and sexual violence. But also to oblige a judge “to motivate the decision not to apply the penalty of ineligibility” in the event of conviction on this subject.
Finally, the authors of the report want each political body and association representing local elected officials to adopt a charter on sexist and sexual violence, in addition to establishing disciplinary sanctions in the internal regulations of assemblies.
