The decree of October 31, 2024 recognizing the state of natural disaster was published this Tuesday, November 5, 2024 in the Official Journal. Many municipalities made the request during the bad weather of October 8 and 16, with the passage of the Kirk depression in particular.
The reason for recognition indicated in the order: The abnormal intensity of the phenomenon during the event is characterized with regard to the precipitation accumulations which have a return period greater than 10 years.

The following are cited in the decree: Cordemais, Saint-André-des-Eaux, Treillières and Vigneux-de-Bretagne. According to the Prefecture, 40 municipalities in Loire-Atlantique had requested this recognition of the state of natural disaster.
The Kirk depression had hit the Loire-Atlantique department very hard on Wednesday October 9: roads and homes were flooded in Couëron, Pornic, Saint-Brevin and La Plaine-sur-Mer in particular.
30 days to make a claim for compensation
The prefecture reminds that from the date of publication in the official journal, victims have a maximum period of 30 days to present or confirm their request for compensation with their insurance company. The state of natural disaster noted by decree may entitle policyholders to coverage against the effects of natural disasters on property covered by the insurance contracts referred to in the Insurance Code, when the resulting direct material damage has had as its determining cause the effect of this natural agent and that the usual measures to be taken to prevent this damage could not prevent their occurrence or could not be taken.
In addition, if the insured is covered by a contract referred to in the insurance code, the state of natural disaster observed may give rise to the right to the aforementioned guarantee, under the conditions provided for in the corresponding insurance contract.
