On June 5, 2023, around 5:25 p.m., a man had “hit from behind” the scooter of a woman, recounted the president of the criminal court (-Atlantique) upon reading the documents in the file.

The license plate of his car had “got stuck” in the two-wheeler but the defendant had nevertheless “left without making any report”.

Loire-Atlantique: he fled after the accident

Cet 44 year old man – who was then at the wheel of a “vehicle of his business “ – had been quickly identified: his boss had been questioned by the gendarmes and told them he was “the only one” driving the vehicle in question.

Although he told the soldiers that he did not “no memory” of such a collision, the man had therefore been condemned in his absence a first time at a fine of €300 and two months from suspension of driving license. The victim had “made a physical description” of the perpetrator which corresponded in every way to her own.

He asks to be tried a second time

The man then formed opposition to the judgmentthat is to say, he had requested to be retried by the same court. This scenario is reserved for litigants condemned in their absence and who were not aware of the date of their trial.

But, while he was to be retried on Tuesday September 24, 2024, the forty-year-old is not still not come to the courthouse from Nantes. The woman, for her part, had made the trip before “returning to her school” in view of the absence of the person concerned. She had left a letter for the judge to tell her that her scooter was “out of order” and that her insurance company was “awaiting the accusation” of the defendant by a court to “intervene” in this case.

The man finally convicted, his sentence doubled

Under these conditions, the public prosecutor had recommended that the judge “double” the sentence handed down the first time with regard to the man, since the accused gives “no explanations”. This defendant had already been convicted three times in the past, she noted.

” It’s a hit and run after an accident material. It’s not the deal of the century, but this behavior is unpleasant,” summarized the representative of the public prosecutor’s office. “It could have had consequences for his employer or for another employee of the company. »

The judge followed her by sentencing the defendant to a fine of €600to a suspension of driving license for four months and a citizenship course “which will do him good”. The civil party, for its part, will be compensated at a subsequent hearing scheduled for 2026.
