The General Confederation of Moroccan Enterprises (CGEM) reiterated, Thursday January 9, 2025, the importance of the promulgation of the law on strike following the meeting held the day before with the Minister of Economic Inclusion, Small
Business, Employment and Skills, Younès Sekkouri.
“In a constructive approach, our confederation has spared no effort in developing a law meeting the expectations of all social partners, particularly the private sector, and ensuring a balance between rights and obligations and in phase with the provisions of the constitution of the Kingdom”indicates the employers in a press release.
This law was to be promulgated during the spring session of Parliament in 2024. Since then, the text has been the subject of extensive consultations with constitutional bodies such as the Economic, Social and Environmental Council (CESE), the National Council for Human Rights l’Homme (CNDH), as well as with the majority of representative unions in social dialogue and in the chamber of advisors.
The project was finally adopted in the House of Representatives on December 25 following discussions which led to the tabling of 334 amendments. The current debate at the level of the Chamber of Advisors will make it possible to collect new recommendations and further enrich this text, underlines the employers. The CGEM also intends to make its contribution on points that it considers “essential” and which “do not appear in the current version of the bill”. The CGEM, however, says it is “confident” about the rapid promulgation of this law, awaited for 62 years, in favor of strengthening the competitiveness of Moroccan companies, particularly SMEs, and promoting the economic attractiveness of our country.
Remember that the text must guarantee on the one hand to workers the right to strike, and on the other hand to non-strikers a certain number of rights and freedoms, including freedom of work. The law must also ensure that the exercise of the right to strike does not endanger the company and in particular SMEs, which are particularly suffering from the current situation.
