Monday, December 16, a 45-year-old man was tried in immediate appearance before the court, to answer for “non-compliance with an obligation imposed by the family affairs judge, in a protection order for a victim of family violence”. He was sentenced to three years and imprisoned.

If there was still a need to remember that the fight against violence against women was one of the major national causes, the Carcassonne court did so again this Monday, December 16, 2024, during the trial of a Carcassonne resident from 45 years old tried in immediate appearance. Released from prison last July, and although he was prohibited from making contact with or appearing at the home of his ex-partner, it was nevertheless close to her home in Carcassonne, rue des Junipers, that a man was taken during the night of Saturday December 14th to Sunday December 15th. He did not have the right to be there, following a protection order issued on September 30 by the family affairs judge (Jaf).

That day, it was first around 7:15 p.m. that the woman's serious danger phone went off, while the defendant had just brought back one of his children for whom he has more or less joint custody. He had tried to enter the home, shouting that she was looking good. Then it calmed down… Until 11:50 p.m. when it was the son who triggered the serious danger phone in place of his mother: “He wants to force his way into the house, come quickly!” When the police arrived, the suspect was no longer there.

But they will end up finding him in the neighbor's garden, where he is on the ground with a screwdriver nearby. As an explanation before the court, the defendant admitted to having brought his eldest son back to his mother around 7 p.m. Then explained that he would have come back later, because he was told that there were burglars in the street. He would have gone to check at the home of his ex’s neighbor…

Pressed by questions from President Anne Nappez, the defendant tried to prove his good faith by indicating that his ex-partner did not respect the bans any more than he did: “I'm not litigious, but I'm going to become one! We had meals together on our own initiative with the children, we've exchanged numerous messages for several weeks… We're still saying it's me, even though It's her. I'm in love, ma'am, she played with me! This is one custody too many, I can't take any more of this.” From the personality of the accused, we learn that he is a temporary mason and that he has two children with his ex-partner. What he wants today: “Take care of myself and my children!” In the interests of the complainant, Me Marion Blondeau carried the path of the one who is today “exhausted, and even capable of putting herself in danger. He came home and it started again! She is no longer able to protect herself. She says yes to everything, because she can't take it anymore…”

For the public prosecutor, its representative noted that we were “in the phase following a domestic violence case, where the victim has locked herself into a relationship which has made her vulnerable… But beyond a victim, there are children who are disturbed by a situation that is beyond them”. The sentence of two years in prison, including six months with a probationary suspension of two years, was thus requested with a committal warrant. In defense, Me Catherine Jocteur-Monrozier looked back on the couple's seventeen years of living together, where everyone agrees that it was a toxic relationship… But the gentleman's difficulties are linked to those of Madame. Prison is not a solution for him. Why not install an anti-reconciliation bracelet with judicial monitoring?” At the end of its deliberations, the court finally sentenced the defendant to three years in prison and issued a committal warrant against him. Upon his release from prison, he will be prohibited from contacting his ex or appearing at her home, under penalty of two years in the event of non-compliance.
