He arrived free at the Versailles court. He left handcuffed, supervised by two police officers. Late in the evening of Thursday December 5, 2024, a teacher from the Jules-Vallès de Plaisir school (Yvelines) was sentenced to 36 months in prison for two sexual assaults committed on students aged 7 and 8 years old. Half of the sentence was met with immediate incarceration in the bar; the other of a probationary suspension. The judges also issued a definitive ban on carrying out professional activity with minors.
The alleged facts date back to the period from September 4, 2023 to March 25, 2024. We are talking about caresses on the chest of one and touching on the lower stomach of the second. At the time the facts were revealed, 78actu had collected various testimonies evoking inappropriate behaviors : hugs, caresses, fake spankings, young girls held on their knees, very wandering hands.
Maybe “too close”
A little stuck in his suit, a single blue stripe cutting his black shirt on the buttonhole, the teacher pleaded his innocencefacing his judges. He fiercely denied any sexual perversion towards children, while admitting to having “been too close” to them in view of his position. An attitude for which he had been recalled to another establishment the year before.
Both the civil party and the prosecution united to deplore a form of coldness and distance on the part of the defendant; just like the absence of “repentance”. All based on the testimony of the mother of one of the victims. Victim for whom telling the truth seems to be of primary importance.
-“Taking a child on your lap is not an offense”
The decision made the teacher's lawyer, Marc Mandicas, jump.
“There is already an inconsistency between the procedure and the final decision. He was made to appear free, under judicial supervision which he respected to the letter. To have him end up in prison. »
And continue. “The Administration sent parents a message to provide information on possible other facts. This created confusion and excitement. Only two charges emerged for which there may be doubt, in the criminal sense of things. Do victims lie? No, but the perception of events is not the same depending on your age. Yes, he was certainly wrong to take a crying child on his lap. But this is not an offense. »
Marc Mandicas has indicated his intention to appeal, blaming the detention. “There is no disturbance to public order. Nothing justified this. He neither killed nor raped anyone. »
