She thought she would have sex with a stranger she met on the internet. In fact, she knew him very well. For three years, a couple from Friborg maintained a so-called BDSM relationship, involving sexual practices such as bondage, submission and sadomasochism. But over time, the woman felt too monitored and oppressed, which is why she ended their relationship.
As the “Freiburger Nachrichten” reports, after the separation, the woman met men on dating sites. Attracted by one of them, she took action. Each time they had sex, the BDSM enthusiast was blindfolded by the man she believed to be a complete stranger. It was only on the third date that she realized that this man was none other than her ex-boyfriend.
According to the newspaper, the investigation revealed that since the separation, he had been monitoring his ex-partner’s emails and spying on him near his home and workplace. In 2022, this Fribourgeois was sentenced by the Veveyse Court to three years in prison, two of which were suspended, for sexual coercion and rape, in particular. At second instance, his sentence was reduced to two years in prison, suspended. But the Federal Court (TF), which considers that the accused stalked and raped his victim using deception, now requires a more severe sentence.
The Supreme Court finds that the defendant did not demonstrate empathy or self-reflection during the proceedings. Furthermore, he knew that his ex-girlfriend would no longer accept sexual relations with him, which is why, according to the TF, the sentence which should be imposed on him cannot be set at the legal minimum. The Cantonal Court will therefore have to re-examine the case.
