In Angers, a resident opposes his neighbors' real estate construction in court. In question, the land where the future house will be located which is used to operate its vehicles, reports Actu.fr.
These are neighborly relations that are off to a bad start. In Angers (Maine-et-Loire), a resident decided to take legal action to challenge the building permit of his new neighbors granted in February 2021 for a reason that is surprising to say the least. As reported by Actu.fr, the Angévin criticizes the city councilor, Christophe Béchu (Horizons), for having authorized the couple to build their house on the adjoining land which allowed them… to turn around with its vehicles.
Manager of a moving company, the man, who is the immediate neighbor of the future house, was in fact used to maneuvering all of his vehicles on the land of his future neighbors. However, today, the latter is forced to exit in reverse.
Arguments rejected on the merits by the public rapporteur
While the mover is within his rights to oppose the future construction in form, the public rapporteur of the court considered that, in substance, his request was not admissible and called on the administrative court of Nantes to reject his request. It must be said that the complainant's arguments do not plead in his favor. Indeed, neither the risks linked to public safety nor the uprooting of trees should be taken into account by the court. The latter also reminded the applicant that future neighbors have the right to locate their house “on the dividing line” of the mover's land. Faced with these elements, the chances for the Angevin mover to see their request successful remain slim. The judgment reserved at the end of the hearing which was held on Thursday, November 21, the judges of the administrative court of Nantes will render their decision “within three weeks”.
