prison term after a punitive expedition in Fumélois

This is what could be called a punitive expedition. It is March 2023, in Fumélois. A 34-year-old individual shows up at the home of a man living in Saint-Vite and mentions a debt of 2000 euros. “Get in my car, it’s better for you!” he tells him.

This is what we could call a punitive expedition. It is March 2023, in Fumélois. A 34-year-old individual shows up at the home of a man living in Saint-Vite and mentions a debt of 2000 euros. “Get in my car, it’s better for you!” the thirty-year-old tells him.

Having been the target of intimidation and threats against him and his family for several days, the Saint-Vitois finally complied. “It was so that all this could be sorted out quickly. But he had a choice. He could have left, gotten out of the vehicle,” the driver defended himself in court. On March 31, 2023, before driving for nearly two hours, they were joined by two other individuals aged 43 and 37. During this journey, an episode of violence allegedly occurred.

The three defendants have extensive criminal records. They were caught thanks to telephone tapping, launched as part of another procedure. This Wednesday, July 3, in court, they are being prosecuted for arrest, kidnapping, sequestration, extortion and violence committed in a group. However, some gray areas remain. In the dock, only one defendant out of three explains himself, the driver. Despite an insistent request for an adjournment by Mes Casellas and Cerdan for the defense, who requested more time to prepare the case, the president chose to judge the case in the absence of the other two defendants. “You have had the day to read the case. That is enough,” the magistrate ruled.

Acquittal and prison sentence

The victim is also not present… “He left the country to go to Portugal, where he is believed to be living. He disappeared into thin air during his judicial supervision. He wanted to escape a one-year sentence for domestic violence,” notes Me Dalia Moldovan, who is intervening for his ex-wife. She too has been threatened. “We do not have the ideal victim in this case against a backdrop of drug trafficking and domestic violence,” notes the deputy prosecutor for whom all the offences and crimes are nevertheless characterised.

The driver was sentenced to two years in prison. The 37-year-old accused was acquitted and the forty-year-old was sentenced to one year in prison. Me Casellas, his lawyer, will appeal.
