From there, the situation escalated over time and occupied the administrative justice agenda, with the USMP accusing the mayor of several failings with regard to the municipal police officer. In fact, the union had asked the Bordeaux administrative court to overturn the refusal of the mayor of Bourg-sur-Gironde to place a screen print in compliance with regulations on the service vehicle used by the municipal police agency. Rejected at first instance, the request was finally upheld by the Bordeaux administrative court of appeal.
No exemption
“The commune of Bourg-sur-Gironde, which employs a single municipal police officer, argued that the vehicle made available to this officer for the exercise of his duties could not be screen-printed since it was used by several services . The court considers, however, that this circumstance does not allow a derogation from the obligation, provided for by the internal security code, of signaling of municipal police service vehicles, which aims to guarantee the identification of these vehicles and their occupants,” said the administrative court of appeal.
