His business lasted two years. Two years during which he sold on internetfrom Lot-et-Garonne, dangerous stuffed animals for the health of the children for whom they were intended. A man was sentenced this Wednesday, November 20, 2024 by the Agen criminal court for deception on the merchandise.
Between 2020 and 2022
This is an investigation by the DDETSPP (departmental directorate of employment, labor, solidarity and population protection) and the Villeneuve-sur-Lot research brigade who revealed the deception. Between July 1, 2020 and June 30, 2022, a man living in Villeneuvois marketed online non-compliant sound fluff to the regulations.
Worse. They could be dangerous for children. Their flaws:
- seam of the pocket containing the battery box not completely closed, allowing the passage of a child's finger.
- absence of mandatory consumer information
The new version of the toy subsequently proposed was also declared non-compliant due to the risk of ingestion of small elements.
To avoid any drama, a procedure for withdrawal, recall of products and destruction of goods was launched on August 5, 2022. The company then ceased all commercial activity.
Nearly €85,000 seized
As part of the legal proceedings for deception on merchandise resulting in a danger to the health of humans or animals, the prosecution was able to seize the sum of €84,900, directly or indirectly resulting from the proceeds of the offense.
For this offense, the accused risked 7 years in prison and a fine of €750,000. The court sentenced him to a fine of €30,000, €20,000 of which is suspended, and confiscation of the seized sums.
