The Federal Administrative Court rejects the appeal of Pro Friborg and Patrimoine suisse against the demolition of the Sugiez station (FR). No obligation imposes on Friborg Public Transport to preserve this building from 1903. This judgment is not final and can be appealed before the Federal Court.

In November 2021, Transports publics fribourgeois (TPF) presented their project to replace the railway infrastructure of Sugiez station, on the Fribourg-Morat-Anet line. The project involves the demolition of the passenger building, considered dilapidated and dangerous due to settlement towards the tracks. It will be replaced by a “mobility hub” accessible to people with reduced mobility.

In a judgment published Friday, the Federal Administrative Court rejects the appeal of the two associations for the protection of built heritage. It notes in essence “that there is no legal obligation to preserve this building, in the absence of protective measures”.

“Local importance”

The judges of St. Gallen recognize that the building received the value C in the census of the Cultural Property Service (SBC) of the canton, which makes it an object of “local importance”. However, no protection measures have been ordered and the building has not been classified. For the court, the appellants’ interpretation according to which he should have been placed under protection because of this notice cannot be followed.

The administrative court, however, expresses its understanding for the disappointment of the appellants in the face of the about-face of the TPF. In 2014, in fact, the company planned to maintain the building, considering that the protection of the stations was justified “as heritage” and that it was necessary to try to integrate them into the new railway infrastructure. At the time, she undertook to draw up an inventory of these buildings which would have been binding on her. (judgment A-584/2023 of June 10, 2024)
