The Nantes administrative court dismissed a resident of Saint-Mathurin who contacted him in May 2021 after the National Housing Agency (Anah) withdrew the benefit of “MaPrimeRénov'” for the purchase of his pellet stove.
The applicant was however granted the principle of payment of this subsidy of €2,500 by a previous decision of Anah on September 25, 2020. But the organization reversed its decision on December 17, 2020 after realizing that the date of the invoice is prior to the date of submission of his request… After having filed a compulsory prior administrative appeal (Rapo), to which Anah had not responded, the Vendéen therefore decided to take the matter to the Nantes administrative court.
It is the beginning of the work that is authentic
“I never had the intention, nor the impression, of not respecting the procedures,” defended the applicant. “I agreed to anticipate the installation of my stove at the request of my installer. » Moreover, if this installation had actually started on August 24, 2020, it did not actually end until October 26, 2020, more than two months later.
More “only work and services started after acknowledgment of receipt by Anah give entitlement to the energy transition bonus, recalls the 2020 decree.
“This acknowledgment of receipt does not constitute a decision to award the bonus. »
Work started too early
However in this file “it appears (…) from an invoice issued on August 24, 2020 by the installer of a pellet stove, but also from the letter of November 10, 2020 sent by the applicant to Anah, that the work (…) began on August 24, 2020, i.e. prior to the acknowledgment of receipt by the National Housing Agency of the bonus request,” notes the Nantes administrative court in a judgment dated October 3, 2024 which has just been made public.
“Anah could legally (…), and even though the reserves were definitively lifted on October 26, 2020 after completion of the final finishing touches, completely withdraw (…) the benefit of the bonus (…) of €2,500. »
